The highly successfully Contract Study Group returns for a second year.  Lawyers from ASA’s Attorneys Council will again facilitate group discussions on key subcontract provisions.

The Contract Study Group in 2011-2012 will take an in depth look at the AIA A401-2007 Subcontract. Over the course of the five sessions, the group will go through a provision-by-provision review of the AIA Subcontract. The AIA provisions will be compared and contrasted to more restrictive and troubling language sometimes used by general contractors. Differences between the AIA A401-2007 and the ASA-endorsed ConsensusDocs 750 Subcontract will also be examined. 

Provisions to be reviewed and discussed this month include:

  • Incorporation by Reference of General Contract Documents
  • Flow Down of Rights and Remedies
  • Scheduling and Work Coordination
  • Pass Through of Liquidated Damages
  • Claims
  • Contractor Remedies for Subcontractor Defaults

All of the participants at the first Study Group will receive course materials for the entire program, including copies of the AIA A401-2007 Subcontract, Consensus Docs 750 Subcontract, many examples of standard subcontract provisions, and a handout discussing the assigned provisions.
